Measures taken by a Port State in accordance with this Agreement shall take full account of the right and the duty of a Port State to take measures, in accordance with international law, to promote the effectiveness of subregional, regional and global Conservation and Management Measures.

Each Contracting Party and Cooperating Non-Contracting Party (hereinafter referred to as CPC’s) may, inter alia, inspect documents, fishing gear and catch on board fishing vessels, when such vessels are voluntarily in its ports or at its offshore terminals. Inspections shall be carried out so that the vessel suffers the minimum interference and inconvenience and that degradation of the quality of the fish is avoided.

Each CPC shall, in accordance with the Resolution 01/03 establishing a Scheme to promote compliance by Non-Contracting Party vessels with Resolutions established by the IOTC, adopt regulations in accordance with international law to prohibit landings and transhipments by Non-Contracting Party vessels where it has been established that the catch of the species covered by the Agreement establishing the IOTC has been taken in a manner which undermines the effectiveness of Conservation and Management Measures adopted by the Commission.

In the event that a Port State considers that there has been evidence of a violation by a Contracting Party or a Non-Contracting Party vessel of a Conservation and Management Measure adopted by the Commission, the Port State shall draw this to the attention of the Flag State concerned and, as appropriate, the Commission. The Port State shall provide the Flag State and the Commission with full documentation of the matter, including any record of inspection. In such cases, the Flag State shall transmit to the Commission details of actions it has taken in respect of the matter.

Nothing in this recommendation affects the exercise by States of their sovereignty over ports in their territory in accordance with international law.

Each CPC shall submit electronically to the IOTC Executive Secretary by 1 July of each year, the list of foreign fishing vessels which have landed in their ports tuna and tuna-like species caught in the IOTC area in the preceding year. This information shall detail the catch composition by weight and species landed.

05/09 Recommendation 05/09 On incidental mortality of seabirds 1

Contracting Parties and Cooperating Non-Contracting Parties (hereinafter referred to as “CPCs”) should inform the IOTC Scientific Committee, if appropriate, and the Commission of the status of their National Plans of Action for Reducing Incidental Catches of Seabirds in Longline Fisheries. The Commission should urge CPCs to implement, if appropriate, the International Plan of Action for Reducing Incidental Catches of Seabirds in Longline Fisheries if they have not yet done so.

CPCs should be encouraged to collect and voluntarily provide IOTC Scientific Committee with all available information on interactions with seabirds, including incidental catches in all fisheries under the purview of IOTC.

07/01 Resolution 07/01 To promote compliance by nationals of Contracting Parties and Cooperating Non-Contracting Parties with IOTC Conservation and Management Measures 1

Without prejudice to the primacy of the responsibility of the flag State, the CPCs shall take appropriate measures, subject to and in accordance with their applicable laws and regulations:

  1. to investigate allegations and/or reports concerning the engagement of any natural or legal persons subject to their jurisdiction in the activities described, inter alia, in paragraph 1 of the Resolution 06/01 on Establishing a List of Vessels Presumed to Have Carried Out Illegal, Unreported and Unregulated Fishing in the IOTC Area; [superseded by Resolution 09/03, then Resolution 11/03, then by Resolution 17/03]
  2. to take actions in response to any verified activities referred to in paragraph 1 i); and
  3. to cooperate for the purpose of implementing the measures and actions referred to in paragraph 1 i).

To this end, relevant agencies of CPCs should cooperate to implement IOTC Conservation and Management Measures and CPCs shall seek the cooperation of the industries within their jurisdiction.

To assist with the implementation of this Resolution, CPCs shall submit reports subject to the national laws of confidentiality to the IOTC Secretariat and other CPCs on the actions and measures taken in accordance with paragraph 1, in a timely fashion.
